The Federal Government’s Role in Online Gambling

There are also federal laws regulating the extent of gambling on Native American land. Congress has prohibited unauthorized transportation of lottery tickets between states. However, there are exceptions to the federal law. Some games are protected under the Skill Game Protection Act, which would clarify the Wire Act to allow for a broad exemption.

In addition, the Internet Gambling Regulation and Tax Enforcement Act is a bill that is currently under consideration by Congress. This bill would impose taxes and licenses on the internet gambling industry. It also includes data security standards and appropriate age and location verification requirements.

The Department of Justice has explored the laws governing online gambling. They have found that the Commerce Clause gives the federal government power to regulate gambling, but they have not been able to successfully challenge the constitutionality of these laws.

Some of these laws have been challenged on the grounds that they impede free speech and violate the First Amendment. However, these attacks have had little success. Nonetheless, they have raised questions about the power of Congress under the Commerce Clause.
